Emefiele's right to enforce his rights will be decided by the court. July 13

An FCT High Court on Tuesday set a July 13 hearing date for the enforcement of fundamental rights suit filed by suspended Central Bank of Nigeria (CBN) Governor Godwin Emefiele.

After hearing submissions from parties in the case, Justice Hamza Muazu set the date.

Counsel for Emefiele Joseph Daudu, SAN, argued in his submission that, contrary to the respondents’ preliminary objection to the originating summons on notice, the court has jurisdiction to hear the case.

According to him, the offences listed against Emefiele are state offences that the FCT High Court could hear.

Tijjani Ghazali, SAN, Counsel to the Attorney-General of the Federation, informed the court that the first respondent is challenging the court’s jurisdiction to hear the case brought before it by the applicant.

He claimed Emefiele’s arrest and detention by the Department of State Services was the result of an administrative decision made by an executive branch.

He went on to say that jurisdiction is determined by the reliefs sought by the applicant.

As a result, he urged the court to dismiss the application, claiming that the allegation of unlawful detention is unfounded because the embattled CBN administration is being detained on the order of an FCT Chief Magistrate Court.

On his part, I. Awo, counsel for the second and third respondents, informed the court that there was a pending order to detain the applicant and urged the court to dismiss the application with costs.
